At Attinson Food Equipment, we are committed to the privacy and security of our customers' information. This Privacy and Security Policy outlines our practices for collecting, using, maintaining, protecting, and disclosing that information.

Your information allows us to process transactions efficiently, fulfill your requests for products and services, and communicate with you regarding orders. To protect your personal information, we implement a variety of security measures when a user places an order, enters, submits, or accesses their information.

All sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology and then transmitted to our Payment gateway providers for processing. We do not store your credit card details after the transaction is complete.

Access to your personal information is restricted to employees who need the information to perform a specific job (e.g., billing or customer service). Furthermore, the computers/servers used to store personally identifiable information are kept in a secure environment.

We use cookies to enhance your experience, gather general visitor information, and track visits to our website. You have the option to accept or decline cookies through your web browser settings.

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information.

Customers retain their rights to privacy and data protection. This includes the right to access, correct, delete, or restrict the use of their personal data.

Product Warranty

At Attinson Food Equipment, we pride ourselves on offering high-quality restaurant equipment to our customers. To ensure your satisfaction and trust in the products we supply, we provide a manufacturer's warranty for all items sold.

All products sold by Attinson Food Equipment come with a manufacturer’s warranty. This warranty covers defects in materials and workmanship under normal use and service for a period specified by the manufacturer from the date of purchase.

The warranty includes repair or replacement of parts that are found to be defective in material or workmanship. The decision to repair or replace will be made solely by the manufacturer or their authorized service agent.

The warranty does not cover:
- Damage resulting from misuse, abuse, accidents, alterations, or improper installation.
- Routine wear and tear or maintenance items.
- Products used in a manner not intended by the manufacturer.
- Costs associated with the transportation of goods to and from the service center.

Attinson Food Equipment shall not be liable for any incidental or consequential damages resulting from the use of the product or arising from any breach of this warranty. This limitation applies to damages of any kind, including but not limited to loss of use, loss of profits, loss of business, or other economic loss.

Payment Terms

All customers are required to follow a Cash on Delivery method. Form of payments is: Visa, MC, Interac and Interac e-Transfer.

Ownership of the goods shall not pass to the purchaser until Attinson Food Equipment has received payment in full for the goods. Until ownership has passed to the purchaser, Attinson Food Equipment retains the right to reclaim possession of the goods.

Risk of loss or damage to the goods passes to the buyer upon delivery, irrespective of whether payment has been made.

Late payments may incur interest at a rate of 7% per month or the maximum rate permitted by law, whichever is lower, calculated daily and compounded monthly.

The buyer will be responsible for all costs incurred by Attinson Food Equipment in collecting overdue payments, including, but not limited to, collection agency fees, reasonable attorney’s fees, and court costs.

If you believe your bill is incorrect, you must contact us within 1 business day of the invoice date to be eligible for adjustments or corrections.

Orders canceled after payment has been processed may be subject to restocking fees and any other costs incurred by Attinson Food Equipment up to the time of cancellation.

Limitation of Liability

Attinson Food Equipment shall only be liable for direct damages suffered, paid, or incurred by you due to an attributable failure of our products to perform as specified, up to the invoice amount of the product in question.

In no event shall Attinson Food Equipment be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, loss of business opportunity, or loss of goodwill, arising out of or related to the use, inability to use, performance or non-performance of any products.

Our liability is further limited to the terms provided under the manufacturer’s warranty for each product sold. We do not offer any additional warranties beyond what is provided by the manufacturer.

Any advice or information provided by Attinson Food Equipment, whether verbally, in writing, or through demonstrations, is given for informational purposes only and does not constitute a warranty or guarantee of performance or durability.

It is the responsibility of the customer to ensure that all products are used in accordance with the manufacturer's guidelines and instructions. Failure to do so may void any available warranty and relieve Attinson Food Equipment of liability.

Customers are also responsible for the proper maintenance and care of the products. Attinson Food Equipment shall not be liable for damages resulting from neglect, improper maintenance, or misuse of products.

Any claim against Attinson Food Equipment under this agreement must be made within one (1) year after the cause of action arises, and any lawsuit relative to any such claim must be filed within one (1) year after the claim is made.

By purchasing products from Attinson Food Equipment, customers acknowledge and agree to these limitations of liability. These limitations apply to all sales and cannot be waived or modified by any representative of Attinson Food Equipment.

Equipment Use

The Equipment is provided for your business operations in accordance with the manufacturer's specifications and operational guidelines. You agree to use the Equipment only for its intended purpose and within the bounds of all applicable laws and regulations.

You may not modify, disassemble, reverse engineer, or perform any act on the Equipment that would alter its functionality or make unauthorized repairs. The Equipment may not be sublet, leased, or loaned to third parties without prior written consent from Attinson Food Equipment.

You are responsible for the regular maintenance and care of the Equipment as specified in the manufacturer's guidelines.

Intellectual Property

All trademarks, service marks, logos, brand names, and any other proprietary designations used in connection with the products and services provided by Attinson Food Equipment are the trademarks or registered trademarks of Attinson Food Equipment or our suppliers and partners. The use of these marks without obtaining prior written consent is strictly prohibited.

The products sold by Attinson Food Equipment may contain intellectual property owned by the manufacturers or third parties. Such intellectual property is subject to the terms and conditions set forth by the respective owners, and Attinson Food Equipment does not grant any rights or licenses to such intellectual property by selling these products.

Any content, including but not limited to, manuals, documentation, and promotional materials provided with the products, are copyrighted by their respective owners and are provided for the buyer's personal use only. Reproduction, modification, distribution, or public display of these materials without prior written consent from the copyright owners is prohibited.

Attinson Food Equipment takes intellectual property rights seriously and expects customers to do the same. If you believe that a product sold by Attinson Food Equipment infringes upon your intellectual property rights, please contact us with detailed information about your claim so that we may investigate the matter further.

Should any products or services provided by Attinson Food Equipment be found to infringe upon intellectual property rights, Attinson Food Equipment will take appropriate action, which may include removing the product from sale, discontinuing the service, or seeking a suitable license agreement.

Continuation of Key Provisions

Notwithstanding the termination or expiration of this agreement, it is understood and agreed that certain rights and obligations set forth herein shall continue in perpetuity. These include, but are not limited to, obligations related to confidentiality, indemnification, liability, and any other provisions which by their nature are intended to survive termination or expiration of this agreement.

By entering into this agreement, both parties acknowledge and agree to the continuation of the specified obligations and rights beyond the termination or expiration of the agreement, recognizing their importance to the integrity and protection of both parties' interests.

Agreement to Terms Upon Order Acceptance

Your order constitutes your acceptance of an agreement to be bound by all terms, conditions, policies, and clauses established by the Company.

You affirm that you have reviewed, understand, and accept our terms, including those related to the use of equipment, limitations of liability, dispute resolution mechanisms, and any other provisions pertinent to the nature of the transaction.

You acknowledge that it is your responsibility to review the aforementioned terms periodically for any changes or updates. Your continued placement of orders following the posting of any changes to our terms and policies constitutes acceptance of those changes.

This acknowledgment serves as a binding agreement between you and the Company, superseding any prior discussions, agreements, or understandings regarding the subject matter hereof.

The rights and obligations under this agreement are personal to you and may not be transferred or assigned to any third party without the prior written consent of the Company.

This agreement and any disputes arising from or related to your order or use of the Company's goods or services shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law principles.
